Acceptance of Terms
By using TCG STATS, you agree to these Terms of Service.
By accessing and using TCG STATS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.
Description of Service
TCG STATS is a multi-platform inventory and order management tool for trading card game sellers. The Service provides:
- Centralized inventory management across multiple selling platforms.
- Automated listing synchronization (pricing, quantities, and status) with Shopify, CardTrader, Cardmarket, eBay, and WooCommerce.
- Order processing and fulfillment tracking from connected platforms.
- Market price analytics and insights for trading cards.
User Accounts
To use the Service, you must create an account using a valid email address. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these terms or are used for unauthorized purposes.
Subscription, Billing & Free Trial
Access to paid features of the Service is provided on a subscription basis. Plans are billed monthly or annually in advance at the rates listed on our pricing page.
Free Trial: New accounts may be offered a free trial (default 7 days, unless otherwise stated). At the end of the trial period, your subscription will automatically convert to the paid plan you selected at signup and your payment method on file will be charged. No further action is required to continue the subscription. If you do not wish to be charged, you must cancel before the trial ends.
Automatic Renewal: Paid subscriptions automatically renew at the end of each billing cycle until cancelled. By subscribing, you authorize us to charge your payment method on each renewal.
Price Changes: We may change subscription prices. Material price changes will be communicated at least 30 days in advance and take effect at your next renewal.
Failed Payments: If a payment fails, we may suspend or terminate your access until the outstanding balance is settled.
Taxes: Prices are exclusive of applicable taxes (such as VAT) unless stated otherwise. You are responsible for any taxes associated with your subscription where required by law.
Cancellation & Refunds
You may cancel your subscription at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period, and you will retain access until that date. Unless the subscription is in the free trial period.
Paid subscription fees are non-refundable except where required by applicable law. We do not provide pro-rated refunds for partial billing periods, unused time, or downgrades.
Where mandatory consumer protection law grants you a statutory right of withdrawal (for example, within the European Union), those rights remain unaffected by this section.
Platform Integrations
The Service integrates with third-party platforms including Shopify, CardTrader, Cardmarket, eBay, WooCommerce, and TCGPlayer. By connecting these platforms, you acknowledge that:
- You are responsible for maintaining valid API credentials and platform accounts.
- TCG STATS is not responsible for changes, outages, or issues caused by third-party platforms.
- Platform-specific terms of service continue to apply to your use of those platforms.
- You authorize TCG STATS to read and write data on your behalf through connected platform APIs.
Connecting third-party platform accounts is entirely at your own risk. TCG STATS synchronizes data using the credentials and API access you provide, but we cannot be held responsible for any damage, loss, suspension, ban, policy violation, or other adverse consequences affecting your platform accounts, listings, inventory, pricing, or orders as a result of using the Service. You are solely responsible for ensuring your use of connected platforms complies with each platform's terms of service, and you accept all risk associated with granting the Service access to those accounts.
Acceptable Use
You agree not to use the Service for any unlawful, fraudulent, or infringing purpose. In particular, you may not:
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Scrape, crawl, or bulk-extract data from the Service beyond the scope of its intended APIs.
- Circumvent rate limits, access controls, authentication, or billing mechanisms.
- Resell, sublicense, or provide access to the Service to third parties without prior written authorization.
- Use the Service to post spam listings, manipulate pricing, or otherwise abuse connected platforms.
- Upload or transmit malicious code, viruses, or any content that infringes intellectual property or privacy rights.
Violation of this section may result in immediate suspension or termination of your account without refund.
Service Availability
The Service is provided on a best-effort basis. We do not guarantee any specific uptime, response time, or availability level unless expressly agreed in a separate written service level agreement.
Scheduled maintenance, unplanned downtime, third-party platform outages, network issues, and external service changes may interrupt or degrade the Service. TCG STATS is not liable for any downtime, delay, data synchronization failure, or loss resulting from such interruptions.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
Intellectual Property
TCG STATS is an independent service and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokemon Company, Wizards of the Coast, Konami, or any other trading card game publisher.
All trading card game names, logos, and related intellectual property are trademarks of their respective owners. Card images and data are used for identification and reference purposes only.
The TCG STATS software, design, and original content are the intellectual property of TCG STATS and may not be reproduced without permission.
Limitation of Liability
The Service is provided "as is" without warranties of any kind, either express or implied. TCG STATS shall not be liable for:
- Any indirect, incidental, special, or consequential damages arising from your use of the Service.
- Loss of data, profits, or business opportunities resulting from Service interruptions or errors.
- Errors or delays in synchronization with third-party platforms.
- Actions taken by third-party platforms regarding your listings, orders, or account.
Our total liability for any claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless TCG STATS, its affiliates, and its officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- Your breach of these Terms of Service or applicable law.
- The content, listings, pricing, or data you submit to or through the Service.
- Your violation of any third party's intellectual property, privacy, or other rights.
- Your use of connected platform accounts and any resulting actions, suspensions, or disputes with those platforms.
Data Processing
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms of Service.
By using the Service, you consent to the processing of data as described in our Privacy Policy, including the collection of order data from connected platforms.
Termination
You may terminate your account at any time by contacting us. Upon termination:
- Your platform connections will be disconnected and authentication tokens deleted.
- Your inventory and listing data will be removed from our systems.
- Order data will be retained according to our data retention policy (180 days) before being anonymized.
We may terminate or suspend your account if you breach these terms, with or without prior notice.
Governing Law & Jurisdiction
These Terms of Service and any dispute arising out of or in connection with them are governed by the laws of the Netherlands, without regard to its conflict of law principles.
The competent courts of the Netherlands shall have exclusive jurisdiction over any dispute, claim, or proceeding relating to these Terms or the Service.
Mandatory consumer protection rights granted to you under the law of your country of residence remain unaffected by this section.
Changes to Terms
We may modify these Terms of Service at any time. When we make material changes, we will notify you via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the updated terms.
